This Client Terms and Conditions Agreement (“Agreement”) governs the use of the Essy Beauty Care Services platform (“Platform”) by any individual or entity booking services through the Platform (“Client”). By registering an account or booking a service, the Client agrees to be bound by the following terms.
1. Nature of the Platform
The Client acknowledges that the Platform serves solely as a digital marketplace connecting Clients with independent beauty and wellness service providers (“Vendors”). Essy Beauty Care Services does not operate, manage, or control the Vendors’ facilities, personnel, or services. All services, treatments, packages, and promotions listed on the Platform are offered and performed solely by the Vendors, who remain fully responsible for service quality, safety, compliance with Malaysian laws, and client outcomes.
2. Client Representations and Warranties
The Client represents and warrants that all personal information provided to the Platform, including full name, contact information, and payment details, is true, accurate, and current. The Client agrees to maintain the confidentiality of any login credentials, to use the Platform for lawful purposes only, and not to engage in fraudulent, abusive, or harmful conduct toward Vendors, other Clients, or the Platform Provider.
3. Booking and Payment
All bookings must be made through the Platform and require full payment in advance to confirm the appointment. The Platform will process payments on behalf of the Vendor and issue receipts confirming the booking. The Client is responsible for reviewing the service description, duration, pricing, and location before confirming the booking. Any errors or discrepancies in the booking are the Client’s responsibility to correct prior to confirmation. Once payment is made and booking is confirmed, cancellations, refunds, or rescheduling shall be governed by the Platform’s Cancellation and Refund Policy.
4. Client Obligations During Service
The Client agrees to provide accurate information regarding health conditions, allergies, or other factors that may affect the delivery of the service. The Client shall arrive punctually at the Vendor’s facility for the scheduled appointment and comply with all reasonable instructions provided by the Vendor to ensure safety and service quality. The Client shall act respectfully and professionally toward all Vendor staff, facilities, and equipment. Misconduct, harassment, or damage to Vendor property may result in the suspension or termination of the Client’s Platform account.
5. Refunds and Cancellations
Refunds shall be issued in accordance with the Platform’s Cancellation and Refund Policy. The Client acknowledges that some bookings may be non-refundable, partially refundable, or subject to penalties depending on the timing of the cancellation and the Vendor’s policies. Refunds will be processed through the original payment method, and the Platform shall not be responsible for delays caused by banks or financial institutions.
6. Limitation of Liability
The Client acknowledges and agrees that Essy Beauty Care Services is not responsible for the acts, omissions, or service quality of Vendors. The Platform Provider shall not be liable for any injuries, allergic reactions, losses, damages, or dissatisfaction arising from the services provided by Vendors. The Client agrees that all risks associated with receiving services are borne entirely by the Vendor, and the Platform acts solely as an intermediary for convenience in bookings and payment processing.
7. Intellectual Property
All materials, trademarks, logos, content, and technology displayed on the Platform remain the intellectual property of Essy Beauty Care Services or its licensors. The Client shall not copy, reproduce, distribute, or create derivative works from any Platform materials without prior written consent.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under or in connection with this Agreement shall fall under the exclusive jurisdiction of the Malaysian courts.
9. Entire Agreement
This Agreement constitutes the entire understanding between the Client and Essy Beauty Care Services regarding use of the Platform and supersedes all prior agreements, communications, and understandings, whether oral or written. No modification to this Agreement shall be valid unless made in writing and signed by the Platform Provider.
By registering on the Platform or booking a service, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
